These Terms and Conditions constitute a legally binding agreement made between you and Adventure Forest, LLC and its affiliates and subsidiaries (“Go Ape”). By ordering or obtaining products from this website you: (1) agree to these terms and conditions in their entirety; (2) are at least 18 years old; and (3) are not prohibited from accessing or using this website or any of this website’s contents, goods, or services by any applicable law, rule, or regulation.
Supplemental terms and conditions that may be posted here or at www.goape.com (collectively, the “Site”) from time to time are expressly incorporated herein by reference. Go Ape reserves the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.
1. Purchases and Payments
If you wish to purchase any product made available through the Site, you may be asked to supply certain information relevant to your transaction including, without limitation, information about your method of payment, your billing address, and your shipping information. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT CARD(S) OR OTHER PAYMENT METHOD(S) UTILIZED IN CONNECTION WITH ANY TRANSACTION. All orders are subject to acceptance by Go Ape. We reserve the right to accept or reject any order in our sole discretion. We reserve the right to cancel any order once accepted by us at any time in our sole discretion.
We reserve the right to correct any errors, inaccuracies, or omissions, including but not limited to products listed at incorrect prices or with incorrect information, at any time and to cancel any orders arising from such occurrences. If your credit card has already been charged for the purchase and your order is canceled, Go Ape shall immediately issue a credit to your credit card account in the amount of the charge.
2. Shipping and Handling
Go Ape will ship your accepted order to you at the address you provide upon making the order. You shall be responsible for all shipping and handling charges, unless notified otherwise by exclusive deal offers. While we agree to use reasonable efforts to meet the shipping and delivery dates provided online, we shall not be responsible for any delays in shipments. Title and risk of loss pass to you upon delivery to the carrier.
3. Return Policy
Except for any products designated on the Site as final sale or non-returnable, if you, for any reason, are not satisfied with your order, you may return it for a store credit or monetary refund; provided: (1) the items(s) were not designated as non-returnable; (2) your return is made within thirty (30) days of purchase; and (3) the merchandise is returned in the same condition as originally received by you. All returns must be made pursuant to the specific return procedure set forth on the Site. You are responsible for all shipping and handling costs on returned items, unless otherwise specified. You bear the risk of loss or damage during shipment (other than when returning non-conforming merchandise) and as such, you are advised to obtain appropriate insurance.
